These Terms of Service ("Terms") govern your use of Fabrika42 ("the Service"), operated by Fabrika42 ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

2. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years of age to use the Service.
  • One person or entity may not maintain more than one account.
  • You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property rights of others.
  • Upload malicious code, viruses, or harmful content.
  • Attempt to gain unauthorized access to the Service or other users' accounts.
  • Use the Service for spam, phishing, or other abusive purposes.
  • Circumvent rate limits, security measures, or access controls.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Share API keys or account credentials with unauthorized parties.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

4.1 Plans and Pricing

  • The Service offers subscription plans with varying features and usage limits.
  • Pricing is displayed on our website and may change with 30 days' notice.
  • All payments are processed by our merchant of record (Lemonsqueezy).

4.2 Billing Cycle

  • Subscriptions are billed monthly or annually, depending on your chosen plan.
  • Billing begins on the date you subscribe and recurs on the same date each cycle.
  • You may switch between plans at any time; changes take effect at the next billing cycle.

4.3 Cancellation

  • You may cancel your subscription at any time from the Billing settings page.
  • Cancellation takes effect at the end of the current billing period.
  • No refunds are issued for partial billing periods.

4.4 Credits

  • Some features use a pay-as-you-go credit system.
  • Credits are non-refundable and non-transferable.
  • Unused credits are forfeited upon account deletion.

5. Intellectual Property

5.1 Our Content

  • The Service, its design, code, and documentation are owned by Fabrika42 and protected by intellectual property laws.
  • We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription.

5.2 Your Content

  • You retain ownership of any content you upload or create through the Service.
  • You grant us a limited license to process, store, and display your content as necessary to provide the Service.
  • You are responsible for ensuring you have the right to upload any content.

6. API Usage

  • API access is governed by these Terms and any additional API-specific documentation.
  • API keys are personal to your account and must not be shared publicly.
  • We reserve the right to set and enforce rate limits on API usage.
  • Excessive or abusive API usage may result in suspension of API access.

7. Privacy and Data Protection

  • We process your personal data in accordance with our Privacy Policy.
  • We comply with the General Data Protection Regulation (GDPR) and applicable data protection laws.
  • You can exercise your data rights (access, export, deletion) from your account settings.

8. Service Availability

  • We aim to provide the Service with reasonable uptime but do not guarantee uninterrupted availability.
  • We may perform scheduled maintenance with advance notice when possible.
  • We are not liable for service disruptions caused by factors beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind.
  • We are not liable for any indirect, incidental, special, or consequential damages.
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Fabrika42, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Account Deletion

  • You may request account deletion from your Settings page.
  • Account deletion has a 30-day cooling-off period during which you can cancel the request.
  • After the cooling-off period, your account and all associated data are permanently deleted.
  • You must leave or transfer ownership of all organizations before deleting your account.
  • Active subscriptions must be cancelled before account deletion.

12. Termination

  • We may suspend or terminate your account for violation of these Terms.
  • Upon termination, your right to use the Service ceases immediately.
  • Sections that by their nature should survive termination will remain in effect (including Limitation of Liability, Indemnification, and Governing Law).

13. Changes to These Terms

  • We may update these Terms from time to time.
  • Material changes will be communicated via email or in-app notification.
  • Continued use of the Service after changes constitutes acceptance.
  • If you do not agree to updated Terms, you may close your account.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Fabrika42 is incorporated. Any disputes will be resolved in the courts of that jurisdiction.
